Terms of Service
By purchasing premade or custom services from Chlobell Design and Hosting, the client is agreeing to the following terms and conditions. Please read them carefully. These terms and conditions are subject to change at any time, without warning and therefore should be read prior to making all of your purchase(s).
Payments & deposits
A deposit of 50% is required in order for you to be placed on our schedule. This deposit will act as a retainer of our time. We currently only accept payments by way of PayPal, but please note that you do not have to have an actual PayPal account to make your payment(s). Balances must be paid in full prior to installation. If you are purchasing premade photoblog designs, please note that additional charges may apply if we are required to modify colors, fonts and graphics (aside from the header).
We will work hard to see that all projects are completed in a timely fashion. Please understand that while we will do our best to provide a completion date within 4 – 8 weeks (unless a rush order is required, to which a $100 rush fee is attached to the final price), they are not deadlines. In some cases a project may require multiple revisions to meet the client’s needs and satisfaction, and these revisions take time.
The premade(s) you purchase are single-use ONLY. If you plan to use our premades on multiple blogs you will be required to pay a multiple-use fee. Our multiple use fee will vary depending on the premade you will to use on more than one blog. Contact us for more information.
We can provide Blogging software for you at a minamil charge that can be added all-carte, you may opt to use your own software.
When a custom design is requested
Client guarantees that they own or have permission from the rightful owner to use any design element such as photography, text, graphics, trademarks or any other artwork that is to be included in any design by Chlobell Design and will hold harmless, protect and defend Chlobell Design and it’s subcontractors from any claim or suit arising from the use of any design elements. Client shall also supply the source of any design element that is to be used and included in any commissioned design project, so that proper credit will be given. Client assumes responsibility and all risk of liability. We do provide an affordalbe stock photo option available alla-carte
When a custom design is requested or premade is purchased
Client understands and agrees that by purchasing any design or design element created by the use of personal photography, designs, text, graphics, trademarks or any other artwork by Chlobell Design the client is not purchasing the rights to claim, reuse, resell or redistribute any design or design elements without prior, written permission of the author.
You are only allowed to use each design on one blog
Use of themes on multiple blogs is not permitted UNLESS you have moved/relocated your blog to a new location, or permission to do so has been granted.
Client agrees that credit links back remain on the site for the life of any design by Chlobell Design. Removal of these credit links are in direct violation of these Terms of Service and your agreement with Chlobell Design. The location of this link may be in the footer or the sidebar of the design, to be determined by the designer. These links may either by a text link or small button/banner if in the sidebar.
Chlobell Design will not save or store backups of any design or design element purchased unless this option is purchased alla-carte. It is the responsibility of the client to save and store backups of previous designs, as well as any design purchased through Chlobell Design unless added to your design package.
Client understands and agrees that Chlobell Design reserves the right to use and display any purchased design, custom design or design elements as examples of works via a portfolio or for the purpose of advertisement.
Once you have been placed on our design schedule you may not be entitled to a full refund. We try to be as fair as possible, and understand that everyone works hard for their money. If you decide to withdrawal your project from our design schedule you may be entitled to a partial (and in some cases a full) refund of your deposit. No refunds will be provided once the client has approved of the final mock up of their design project.
We urge you to please only commit to a project if you are 100% sure that it’s something you want and are willing to wait on depending on the time line you have been given.
Chlobell Design will provide limited, 72 hours of customer service to allow for any minor adjustments and maintenance to any custom project. After 72 hours, you may be charged an additional fee of $25 per hour.
